On Tuesday, Sept. 14 Arizona’s Attorney General Mark Brnovich stated that his office will be filing a lawsuit over President Biden and his administration’s federal vaccine mandate. 

Republican Brnovich and his office are suing the Biden administration for their new vaccine or weekly covid testing mandate on private businesses with more than 100 or more employees. This requirement could possibly affect 100 million Americans (⅔ of the workforce in America) to get the vaccine or weekly testing. Biden’s reason for this mandate was to stop the spread of the global virus, COVID-19. There have been a variety of feelings and thoughts about this mandate. An example of this would be the lawsuit Brnovich is filing for something that has not fully been decided yet. 

While the administration has not yet fully specified rules and regulations about the vaccine mandate, Brnovich has quite a few thoughts about the mandate. Stating, “there is an uncertainty, confusion, as to what the president can or can’t do.” Brnovich has also expressed the situation as an “unprecedented and unconstitutional power grab” the debate whether it is unconstitutional is currently going on, but people like Brnovich have already taken action. Based on an email, Brnovich’s personal view on the matter is that the government cannot force people to get the vaccine. Describing it as, “Egregious federal overreach” and what he thinks is representing the state of Ariona by stating that, “Arizona will not tolerate this assault on our sovereignty.”

His office claims that the policy is violating the Equal Protection Clause by, as stated, “favoring migrants” and “protecting their freedom and bodily autonomy more than American citizens.’’ His office continues to state more about migrants, and he himself states, “There can be no serious or scientific discussion about containing the spread of COVID-19 that doesn’t begin at our southern border.”
