'Until the Count of 3': Police Say a Road Rage Suspect Carries Out His Threat to Shoot a Guy During a Fight

HPP: A road rage argument in Georgia resulted in a shooting when a suspect allegedly made good on his promise to open fire on the victim after counting to three. The victim was not injured in the incident.

Aggravated assault, possession of a firearm during the commission of a crime, and careless driving are the allegations that have been brought against Josue Colon Matos, who is thirty years old.

He is currently being held without bond at the Gwinnett County Jail.

WSB was able to get footage from body cameras and presented a copy of the arrest document that included specifics regarding the incident that occurred on December 23 in Duluth, which is approximately 30 miles northeast of Atlanta.

A person was reported to have been shot in the 3800 block of Pleasant Hill Road at approximately eight o’clock in the evening. Officers from the Duluth Police Department responded to the incident.

Upon arrival, the officer discovered the victim suffering from what was described as a “obvious gunshot wound to the left foot.”

“I can’t believe he shot me … He was tailgating me,” the victim said in the body camera video. “He kept bothering me, and I got upset.”

He was transported to the hospital by paramedics for medical care.

The victim then said to the police that once the man began following him, he pulled into a parking lot, and the suspect, who was eventually identified as Matos, followed him in.

The victim got out of his vehicle and approached the vehicle that was being driven by the suspect. During the argument, Matos allegedly pulled out a revolver and told the victim that he had “until the count of three” to leave him alone.

This is according to the affidavit, which states that Matos got out of the vehicle and both men began shouting.

In accordance with the police, Matos allegedly counted to three before shooting the victim. It was then when the suspect drove away.

Police were able to locate and apprehend him with the assistance of traffic cameras. In contrast to the version of events provided by the police, his counsel provided a different story.

“We anticipate the evidence will show the other driver was the primary aggressor and that Mr. Matos’ actions were in self-defense,” the attorney, Robert King, stated.

On January 17, Matos is set to appear in court for a hearing.
